Scope of Application 1.1. The following General Terms and Conditions (hereinafter “AGB”) govern the contractual relationship between Thorsten Milse wildlifephotography (hereinafter “Provider” or “we”) and our customers (hereinafter “Customer” or “you”) regarding all sales via the website https://thorstenmilse.de (hereinafter “Website”). 1.2. Deviating conditions of the Customer shall not be recognized unless the Provider has expressly agreed to their validity in writing.
Conclusion of Contract 2.1. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. 2.2. By clicking the “order with obligation to pay” button, you place a binding order for the goods contained in the shopping cart. The contract is concluded when the Provider accepts the Customer’s order by sending an order confirmation by email.
Prices and Payment Conditions 3.1. All prices on the website are inclusive of statutory value-added tax and plus shipping costs. 3.2. Payment shall be made in advance, via PayPal, or other payment methods offered during the ordering process.
Delivery and Shipping 4.1. Delivery shall be made within the delivery period specified on the respective product page after receipt of payment. 4.2. Shipping costs will be clearly communicated to you before the order is completed.
Right of Withdrawal 5.1. You have a legal right of withdrawal. You can revoke your contractual declaration within 14 days without giving reasons in writing (e.g., letter, email). The withdrawal period begins upon receipt of the goods but not before receipt of this revocation instruction in written form. 5.2. To comply with the withdrawal period, it is sufficient to send the withdrawal or the goods in due time. The withdrawal must be addressed to: Thorsten Milse Amselweg 32 A, 48565 Steinfurt, Germany 5.3. In the event of an effective withdrawal, the mutually received benefits shall be returned. You are obliged to return the goods if they can be shipped by parcel. You shall bear the costs of returning the goods. 5.4. Please note that we can only accept returns if the goods are undamaged and in perfect condition. In case of damage or contamination, we reserve the right to charge for the loss in value or refuse the withdrawal. 5.5. Your right of withdrawal shall expire prematurely if the contract has been fully fulfilled by both parties at your express request before you have exercised your right of withdrawal.
Warranty and Liability 6.1. Warranty shall be based on statutory provisions. 6.2. We shall be liable without limitation for damages resulting from injury to life, body, or health caused by our negligent breach of duty or by intentional or negligent breach of duty by a legal representative or vicarious agent.
Final Provisions 7.1. German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. 7.2. The place of performance and exclusive place of jurisdiction for all disputes arising from this contract is our registered office: Thorsten Milse, Amselweg 32 A, 48565 Steinfurt, Germany.
